Note: this event is hosted on limited basis (by invitation) and only eligible for members of Indonesia Corporate Counsel Association (ICCA).
The International Chamber of Commerce (ICC) and Indonesia Corporate Counsel Association (ICCA) is co-organizing a tailored training which covers topics on risk management in Dispute Prevention and Resolution. The training will be held in a roundtable manner which allows participants to engage in an interactive dialogue with prominent speakers on each respective topic. The training will be conducted in English, with Speakers whom are either also native speaker of Bahasa Indonesia, or have proficiency in Bahasa Indonesia.

So you are drafting a contract: what to look for and how?
Contract drafting and execution are two crucial aspects for In-House Counsel’s day-to-day work. Notwithstanding the value, size, terms, and complexity of your business transaction, drafting a proper contract shall not be a template-based exercise. Discussion includes:

- Negotiating contracts: provisions that can reduce risk. e.g. no waiver, termination, limitations, amendment, and
- Dispute resolution clause: a provision intended to mitigate, prevent, and/or remedy potential or incurred loss arising out of or in connection with the contract performance
Now your contracts are signed: what to do and to watch out for next?
After the signing, In-House Counsel is tasked to monitor the performance of the contract. As an intermediary (and often a right-hand) to the C-suite, In-House Counsel is responsible for updates and progress of the transaction.
Discussion includes:
- Changes and variations to the contract,
- Contractual fulfillment and any issues that emerge out of the projects/transactions.
Are you seeing signs of dispute: how to manage and handle these?
You see that dispute is imminent and as an In-House Counsel, you often dwell as to whether you would like to pursue dispute resolution through court litigation or other alternative dispute resolution mechanisms such as arbitration. Discussion includes:
- Procedural and risk management steps of handling dispute,
- Why and how arbitration is the most preferred dispute resolution mechanism to suit business needs and how ICC arbitration is a neutral and efficient means of resolving disputes.
