Public policy remains one of the most complex and evolving dimensions of international arbitration. Is it a safeguard for justice, or a procedural tool increasingly used to challenge arbitral outcomes?

 

This roundtable, organized by the International Chamber of Commerce (ICC), will convene leading practitioners and scholars to examine how arbitral tribunals and national courts define and apply public policy—both procedurally and substantively. Particular attention will be given to Lusophone jurisdictions, with comparative insights from France.

 

The discussion will address key issues such as corruption, procedural fairness, and the emergence of new dimensions of public policy in arbitral practice. It will also explore the divergent approaches to annulment and enforcement across jurisdictions, and whether global trends are fostering convergence or reinforcing national particularities.

 

This event offers a unique opportunity to engage with current debates and gain practical insights into one of arbitration’s most debated frontiers.
