Threading tapestries: taking stocks of current issues and future developments of arbitration law in Indonesia

In recent years, the Indonesian Courts have issued rulings on the application of Law No 30 of 1999 on Arbitration and Alternative Dispute Resolution (“Arbitration Law”). From interpretation of wordings to the scope and definition of public policy of the Arbitration Law and more, calls for revision to the Indonesian Law are as collective and as necessary as ever. The Panel will assess key takeaways from the said rulings and consider what would be the areas of improvement should the Arbitration Law be amended as to have it aligned with global trends and best practices of international arbitration.

Balancing the scales: things in check for damages claims in arbitration

As international arbitration deals with different governing laws and seats, some concepts related to damages claims differ from one jurisdiction to another. Parties, legal representatives, tribunals, and experts shall approach such claims with caution and thoroughly consider what is admissible and what is allowed by the applicable laws. The Panel will discuss this topic in the context of domestic and international arbitration, particularly when they involve Indonesian parties and law.
