While arbitration often takes center stage in commercial dispute resolution, other tools and techniques aimed at ensuring business continuity are sometimes overlooked. Dispute prevention mechanisms, mediation, expert determination, dispute boards, and other innovative ADR tools and techniques can sometimes be a better fit for business needs by offering faster, more cost-effective paths to managing conflict. The ability to navigate a range of dispute prevention and dispute resolution tools and techniques is especially important in high-stakes, fast-moving business environments like Silicon Valley.

This interactive panel will explore how companies, counsel, and arbitrators can better integrate existing techniques & tools and adopt creative new approaches to preventing and managing disputes. Audience members will be invited to engage directly with panelists’ ideas and share their own experiences in helping parties get back to business.
