ICC YAAF: Arbitration under scrutiny: Are we doing it right?
Join us for an afternoon conference to discuss relevant topics for commercial arbitration. The first panel is a mock arbitration regarding early dismissal under the ICC Rules, including counsel in favour of it, counsel against it, and a Tribunal to discuss after the mock trial. The second panel provides an in-depth discussion regarding the duty of disclosure.
This ICC YAAF will analyze relevant matters for arbitration, considering the new ICC Arbitration Rules and the duty of disclosure, which is particularly relevant in Peru, where state-contracts have mandatory arbitration clauses.
The first panel will follow the mock trial (arbitral ring) dynamic. It will include two counsels defending each proposition, as well as three arbitrators, which will simulate a hearing with the counsel, and then comment about the discussed topic. In this panel, the topic will be early dismissal under the ICC Rules. One side will be in favor of it, and the other against it.
The second panel will include three practitioners and one moderator, who will discuss the duty of disclosure of the arbitrators. It is intended to be a very dynamic conversation between practitioners with different backgrounds and perspectives. The moderator would ask the panelists several questions, with the other panelists having a chance to comment, for it to be a very interactive discussion.
