ICC YAAF x IWIRC: Unravelling Cross-Border Insolvency & International Arbitration
Malaysia’s proposed Cross-Border Insolvency Bill ("Bill"), which adopts the UNCITRAL Model Law, marks a pivotal step in aligning local insolvency practices with international standards. As global businesses increasingly face multi-jurisdictional insolvency risks, the Bill has significant implications for how courts, creditors, and arbitral tribunals — particularly in the context of international arbitration — manage overlapping claims, enforcement, and the treatment of foreign insolvency proceedings. It offers a more predictable and harmonised framework, which is crucial for cross-border disputes where arbitration is the chosen forum.
Jointly organised by ICC YAAF and the International Women’s Insolvency & Restructuring Confederation (IWIRC), the discussion will consider the recognition of foreign insolvency proceedings, treatment of foreign creditors, and the arbitrability of insolvency-related claims. It will also offer practical insights on managing insolvency risks in cross-border commercial disputes, particularly where international arbitration is the forum of choice. Can arbitration be an aid in resolving restructuring and insolvency issues?
