ICC YAAF: This House Believes Investor-State Arbitration is Incompatible with Climate Action

As the world strives to fight climate change, the International Energy Agency warns that keeping global warming below 1.5°C requires halting all new oil and gas projects. Yet many governments hesitate to enact bold climate policies, fearing multi-billion dollar investor claims under international treaties. Are international investment treaties and investor State arbitration standing in the way of effective climate action, or can they coexist with a green agenda?
Four speakers, two in favour and two against, will go head-to-head, with an experienced practitioner presiding as judge. The event promises to deliver a thought-provoking session exploring the tension between environmental imperatives and investor rights, a debate at the heart of international arbitration's future in the climate era.
