ICC YAAF: The New 2026 ICC Rules
Join us for a deep dive with one of the leading figures of ICC arbitration on the most significant development in institutional arbitration this year: the new 2026 ICC Rules of Arbitration.
Effective 1 June 2026, the revised ICC Rules bring the most substantial changes to ICC arbitration in years. The mandatory Terms of Reference – long a hallmark of ICC proceedings – are abolished, with a strengthened initial case management conference taking their place. A new opt-in Highly Expedited Arbitration Procedure (HEAP) offers a sole-arbitrator award within three months, the Expedited Procedure threshold rises from US$3 million to US$4 million, and tribunals gain an express power of early determination to dispose of claims that are manifestly without merit. The Rules also expand emergency arbitration and now regulate tribunal secretaries in the Rules rather than the ICC Note to Parties and Tribunals.
