ICC YAAF: DABs in Latin America: Practice, Prevention and Arbitration
This ICC YAAF regional event brings together practitioners from Latin America to discuss the practical implementation of Dispute Avoidance Boards (DABs) in infrastructure and PPP projects, moving beyond theory to focus on what works in practice — and what does not — in the region.
The first panel will address case experiences from public works and PPP projects, identifying success factors, common challenges, and the need to adapt DAB structures to institutional, regulatory and cultural realities in Latin America.
The second panel will explore the relationship between DABs, arbitration and litigation, analysing whether these mechanisms operate in competition or in a complementary manner, and how DABs can serve as an effective preventive tool to reduce costs, delays and the escalation of disputes.
Special attention will be given to FIDIC-based contracts and locally adapted contractual models, highlighting emerging regional trends and practical drafting considerations.
