Contract or Treaty: Where Should You Bring Your Claim?
Jointly organised by ICC YAAF and Young ICSID, this panel will take place on the evening of 5 November 2026 at the International Chamber of Commerce Headquarters in Paris, ahead of the 39th AAA-ICDR – ICC – ICSID Joint Colloquium on International Arbitration.
Investors facing a dispute with a state often hold two potential avenues of recourse: a contractual dispute resolution clause and, where available, an investment treaty. The choice between them raises questions of jurisdiction, applicable law, available remedies, and enforcement, and can prove decisive to the outcome of a case.
This panel brings together a range of perspectives to examine the strategic considerations behind that choice.
