09.50 - 10.50 Session 1: Focus on Africa

Construction projects across Sub-Saharan Africa are booming — and so are the disputes. From sometimes poorly defined scopes to late payments and cross-border coordination challenges, the region faces a unique matrix of risks that fuel conflicts in infrastructure development. This session will unpack the key sources of construction disputes in the region, explores practical and culturally attuned alternative dispute resolution mechanisms, and critically examines what role development banks and international lenders play / should play in shaping both risk management and dispute resolution pathways. Our panel will also reflect on the fact that very few African countries have attempted to address payment issues through statutory or regulatory reform and consider whether more practical solutions such as adjudication bonds could be part of the answer.

  • Thomas Guerinel, Senior Legal Counsel, Razel-Bec France

  • Ngo‑Martins Okonmah, Partner, Aluko & Oyebode, Nigeria

  • Suzanne Rattray, Adjudicator/Arbitrator, Rankin Engineering, Zambia

11.50 - 12.50 Session 2: Dispute Boards - Their mysterious ways and the path to enforcing DB decisions

This session will examine the evolving role of Dispute Boards (DBs), the DB process under FIDIC contracts and how DB decisions are enforced in Arbitration. Key topics will include:

  • The forgotten art of asking questions: inquisitorial powers of DB members

  • Due process in DB/DAAB proceedings: how much process is due?

  • The role of the ICC Expert Rules and ICC Mediation in dispute avoidance and resolution within FIDIC contracts, before, during, and after a DB decision is issued

  • Hot topics in DB practice: enforcement of DB decisions, including an overview of the factors considered by ICC arbitral tribunals when deciding on requests for partial or interim awards enforcing DB decisions.

  • Fatima Balfaqeeh, Managing Partner, Balfaqeeh Advocates & Legal Consultants; Vice Chair, ICC UAE's Commission on Arbitration & ADR

  • Roberto Hernandez-Garcia, Managing Partner, Comad, SC, Mexico

14.50 - 15.50 Session 3: Oxford-Style Debate - This house believes that Time-Bar provisions in FIDIC Contracts are unnecessary, unfair and unenforceable

With passionate experts on both sides, this debate will challenge the very foundation of time-bar provisions and leave you questioning whether they help or hinder true contract fairness.

Against the proposition:

  • Swee Im Tan, Independent Arbitrator, 39 Essex Chamber, Malaysia; Alternate Member, ICC International Court of Arbitration

  • Vincent Leloup, Chair, FIDIC Contracts Committee; Founder & Managing Partner, Exequatur, France

In favor of the proposition:

16.50-17.50 Session 4: It all comes down to evidence: how to make sure you have the evidence you need, when you need it?

Parties to construction disputes too often learn the hard way, at the arbitration stage, that they do not have all the contemporary evidence they need to prove their case, and/or that they allowed unhelpful evidence to be generated, due to imperfect project management practices. This session will explore best practices, “do’s”, “don’ts”, throughout the project life cycle, based on real-life experience of seasoned professionals.
