Managing privileges issues in arbitration: rule of thumb, by the book?

Issues concerning legal privileges frequently happen in arbitration. Lack of universal rules and different legal traditions as well as applicable law opens doors to privileges issues in arbitration. This is particular in cases where parties are from both civil and common law jurisdictions and have  different doctrines and laws governing privileges. This session will take stock of typical civil and common law issues in relation to privileges in arbitration, and how arbitral tribunal approach privileges issues in practice.

14:30-15:30

Rapid-fire debate: Parties to arbitration have absolute discretion in appointment of arbitrators.

For the motion: This House believes that party’s autonomy in choices of arbitrators prevails above all else.

Against the motion: This House believes that party’s autonomy in choices of arbitrators must  be balanced with credibility and expertise of arbitrators.
