14:00-15:10 Expedited Arbitration Procedures in International Arbitration

Chinese companies, including multinational companies, state-owned enterprises (SOEs) and small and medium-sized enterprises (SMEs), have strong demands for swift, cost-effective and simplified mechanisms to resolve their cross-border disputes. Expedited arbitration has gained growing attention for responding to companies’ needs for more time and cost effective in international arbitration proceedings. Since the inclusion of Expedited Procedure Provisions (EPP) in 2017 ICC Rules of Arbitration , ICC has administered around 900 cases under the expedited procedure rules. The Working Group of the ICC Commission on Arbitration and ADR is also currently updating the EPP to serve the increasing demand for high-quality expedited procedures. This session will share the ICC’s global experience and offer practical skills to Chinese companies on optimising expedited arbitration procedures in their dispute resolution.

15:30-16:40 ICC Dispute Boards Rules: How Chinese Companies Adopt in their Mid- or Long-Term Contracts

A Dispute Board (“DB”), a standing body composed of one or three DB Members, is typically set up upon the signature or commencement of performance of a mid- or long-term contract. A DB is adopted to help parties avoid or overcome any disagreements or disputes that arise during the implementation of the contract, largely in construction projects, but also in research and development; intellectual property; production sharing and shareholder agreements. For global contractors such as Chinese companies engaged in the Belt and Road projects, the strategic application of DB can shape the outcome of multimillion-dollar projects. This session will discuss the strategic application of DBs as well as other procedural steps up to and including arbitration, offering practical insights for Chinese companies.
